    Committee members discussed the application and in doing so, a number of concerns were expressed about road safety matters, particularly in respect of the speed limit on the road and pedestrian access to the convenience store. Members were mindful that the application site was close to two large sites of planned and proposed developments and the opportunity provided by the 24/7 operation of the convenience store.

     

    Members were interested in the timelines for the installation of electric vehicle charging points and the differences between the proposed development and existing petrol stations.

     

    It was proposed, seconded, and on being put to the vote, agreed, to defer application S18/2263 to obtain further information on road safety matters and speed issues with particular reference to footpath and pedestrian access.

     

    It was then, proposed, seconded and agreed that application S18/2264 be deferred pending the determination of application S18/2263.

    Councillor Adams stated that the application site was within his county Division and as such had attended meetings between planning officers and members of the parish council, spoken with the agent and been lobbied by other residents of Castle Bytham. He stated that he had listened to what they had said, made no comment and kept an open mind in respect of the application. As the Ward Councillor for the area, Councillor Benn stated that he too had spoken to numerous people about the application but that he retained an open mind on the issue.

    Members noted the planning history of the site and the decision of the Planning Inspector. They also considered the application site in the context of nearby heritage assets and the characteristics of other properties within the village. Members expressed support for the principle of development on the site but there was a consensus that the proposals were not sympathetic to its situation.

     

    It was proposed, seconded and agreed that the application be deferred to enable interested parties to come together to see whether they could come to a solution that would meet the aims of the applicant, the parish council and the local planning authority. Members indicated that they were not happy with the location of the large house within the site, nor the design principles. Members wanted the large house to be relocated to a part of the site where it would not have such an impact on any heritage asset. The suggestion was also made that a smaller property that was more in-keeping with the style of other buildings in the village and the nearby listed buildings would help to make the proposals more acceptable

    It was proposed, seconded and agreed that the application be approved for the reasons set out in the case officer’s report and subject to the conditions set out on pages 113 to 116 of the case officer’s report and subject to completion of a Section 106 agreement to secure the requirements specified in section 7.9 of the report and amended by the additional items paper issued on Thursday 20 June 2019. Where the Section 106 obligation has not been concluded prior to the Committee, a period not exceeding twelve weeks after the date of the Committee shall be set for the completion of that obligation.

     

    In the event that the agreement has not been concluded within the twelve-week period and where, in the opinion of the Head of Development Management, there are not extenuating circumstances that would justify a further extension of time, the related planning application shall be refused planning permission for the appropriate reasons(s) on the basis that the necessary criteria essential to make what would otherwise be unacceptable development acceptable have not been forthcoming.

    As this application was part-heard, only Councillors who were present on 16 October 2018 when the application was first considered were able to take part in discussion and vote on the application. Those members who were eligible to participate were Councillors Dilks, Exton, Kaberry-Brown, Reid, Jacky Smith and Judy Smith. While Councillor Adams had not been present when the application had first been considered he remained in the chair but did not join in debate or vote on the item.
