    Members debated the application at length and expressed sympathy for both the concerns of residents concerning odour, pollution, and increased traffic movement.  They also considered the presentation made by the headteacher of the local school which relayed the perception of parents who had threatened to remove their children and how this might affect the future viability of the school.  It was also mentioned that the location of the facility being only one mile from Great Ponton and on an elevated site made it visible on the landscape. Despite assurances by the agent and the technical expert, Members felt that surface water would naturally drain towards the River Witham and as a consequence, potentially cause pollution from cleaning water and chemicals including ammonia used by the operation. Members therefore felt that it was not a suitable site for this type of development. 

     

    The Principal Planning Officer warned the Committee that in his view any appeal against refusal would be successful and costs could be significant.

    There was a query as to the one noise complaint that had been reported relating to the operation.  It was noted that the complaint was not upheld by Environmental Health after monitoring activities at the site.  The complainant was asked to complete a date log detailing offensive activity, however this had not been submitted within the allocated timeframe.

     

    It was proposed, seconded and agreed that the application be approved for the summary of reasons set out in the case officer’s report and subject also to the following conditions:

     

    Time Limit for Commencement

     

    1        The development hereby permitted shall be commenced before the expiration of three years from the date of this permission.

    14:30 - As the meeting had been in progress for 3 hours, the Chairman asked for Members’ consent to continue. Members agreed.

     

    Although Members had sympathy with the proposal and the need for this type of facility, they were not convinced as to the location and had concerns regarding the close proximity to other properties, impact on neighbours’ amenity and the sustainability of the operation.  Members felt there was merit in having as much information as possible as to the operating, regulation and monitoring of the home before approving such a scheme.

     

    It was proposed, seconded and agreed that the application be deferred to enable the gathering of further information on the home’s impact on neighbours, the regulation and monitoring by other public bodies such as social services and the police and to allow Members to visit another similar residential home ran by the company.

    Members felt that the development would have a detrimental impact on the historic views of Stamford and were concerned that Stamford needed more affordable housing than the development provided for. 

     

    The Head of Development Management advised that permitted development rights could be removed to ensure there was sympathetic screening and soft landscaping and boundary treatments for perpetuity to retain and enhance the historic views of Stamford as well as building materials only be approved that ensured the development blended into the site and not be eye catching so as to spoil the view.

     

    It was proposed and seconded that Members were minded to refuse the application.  The Head of Development Management stated that she was not able to accept the reasons for refusal as defensible planning reasons. As the proposition to refuse the application was contrary to officer recommendations and the Head of Development Management did not consider the proposed reasons for refusal were sufficient, the cooling off period set out in Article 9.1.9 (c) of the Council’s Constitution was invoked.  In accordance with the Constitution, a recorded vote was taken:
