    It was proposed, seconded and agreed that the application be refused for the following reasons:

     

    1.    It is considered that by virtue of the scale, height, extensive massing and close proximity, the proposed single storey extension would result in the creation of an overbearing environment resulting in an unacceptable impact on amenity of the occupiers of the adjoining dwellings. This would be detrimental to the residential amenities of occupiers of 80 Denton Avenue and 44 Hunt Lea Avenue, contrary to the NPPF Section 12 and policy DE1 of the South Kesteven Local Plan.

     

    2.    It is considered that by virtue of the position and close proximity of fenestration, the proposed single storey extension would result in significant overlooking and loss of privacy to the neighbouring dwellings, in particular, 80 Denton Avenue, Grantham.  This would be detrimental to the reasonable residential amenities of occupiers of that property, contrary to the NPPF Section 12, and Policy DE1 of the South Kesteven Local Plan.

    As this application was part-heard and Councillor Jacky Smith had not been present when it had been considered previously, she did not participate in the discussion or vote on the application.

    The application had been considered and deferred by the Planning Committee on 8 January 2020 and the relevant minutes of that meeting stated as follows:

     

    ‘Although Members had sympathy with the proposal and the need for this type of facility, they were not convinced as to the location and had concerns regarding the close proximity to other properties, impact on neighbours’ amenity and the sustainability of the operation. Members felt there was merit in having as much information as possible as to the operating, regulation and monitoring of the home before approving such a scheme.

    It was proposed, seconded and agreed that the application be deferred to enable the gathering of further information on the home’s impact on neighbours, the regulation and monitoring by other public bodies such as social services and the police and to allow Members to visit another similar residential home ran by the company.’

     

    During the time since the deferral the applicant had supplied copies of Ofsted reports for some of its current children’s homes and those operated by its sister company, Unity, and arranged for a visit to be made by Members of the Planning Committee to one of its children’s homes.

     

    It was proposed and seconded that the application be approved and the motion was lost at the vote.

     

    It was proposed, seconded and agreed that the application be refused for the following reasons:

     

    1.    The application property is located in a remote rural location outside of any settlement, in a location where all employees and visitors will necessarily need to access the site by private car. Moreover, the site is located some distance from the school which intending occupiers will attend, necessitating lengthy journeys to and from the school.

     

    It is considered that the site represents an unsustainable location for the form and type of development proposed. The development does not fall within any of the stated categories of development permitted in open countryside locations set out within Policy SP5 of the South Kesteven Local Plan, and represents an inappropriate form of development in open countryside.
