    subject to the conditions set out in the report and subject to completion of a Section 106 planning obligation securing the requirements specified in the developer contributions section of the report. Where the Section 106 obligation has not been concluded prior to the Committee, a period not exceeding twelve weeks after the date of the Committee shall be set for the completion of that obligation.

    In the event that the agreement has not been concluded within the twelve-week period and where, in the opinion of the Interim Head of Development Management, there are no extenuating circumstances which would justify a further extension of time, the related planning application shall be refused planning permission for the appropriate reason(s) on the basis that the necessary criteria essential to make what would otherwise be unacceptable development acceptable have not been forthcoming.

     

    Upon successful completion of the Section 106 Agreement, the approved application is to be subject to the following conditions:

    12:55 – Councillor Clack left the meeting

     

    In considering the application, Members raised concerns about the height of the proposed dwelling and the potential for it to negatively affect the amenity of the neighbouring properties as a one and a half storey building.

     

    13:07 – Councillor Kaberry-Brown stated that she had not heard the preceding part of the debate due to technical issues. Officers confirmed that she would not be able to participate in the vote on this application

     

    The Committee also queried the definition of the application site as a brownfield site and the policies within the South Kesteven Local Plan that had therefore been considered applicable. 

     

    13:17 - As the meeting had been in progress for 3 hours, the Chairman asked for Members’ consent to continue. Members agreed

     

    It was proposed and seconded that the application be approved conditionally, as recommended by the Planning Officer, but on being put to the vote the proposition was not carried.

     

    A proposition was put forward that the Committee was minded to refuse the application. As the proposition to refuse the application was contrary to officer recommendations, the cooling off period set out in Article 9.1.9 (c) of the Council’s Constitution was invoked, in line with the meeting procedure for virtual Planning Committee meetings. In accordance with the Constitution, a recorded vote was taken:

     

    For: Councillors Bellamy, Bisnauthsing, Dilks, Milnes, Reid, Judy Smith and Adams (7)

    Against: Councillors Exton, Selby and Jacky Smith (3)

    Abstain: Councillor Cottier (1)

     

    As Councillor Kaberry-Brown had not been present for the full discussion of this item, she did not participate in the vote.

     

    The vote was carried and those Committee Members who voted in favour of the proposition had five working days to provide the Interim Head of Development Management with the planning reasons for their view, together with supporting evidence.     It was proposed, seconded and agreed that the application be refused for the following reasons:

     

    1        It is considered that by virtue of the scale, height, extensive massing and close proximity, the proposed single storey extension would result in the creation of an overbearing and unneighbourly environment resulting in an unacceptable impact on amenity of the occupiers of the adjoining dwellings. This would be detrimental to the residential amenities of occupiers of 80 Denton Avenue and 44 Hunt Lea Avenue, contrary to the NPPF Section 12 and policy DE1 of the South Kesteven Local Plan.

     

    2        It is considered that by virtue of the position and close proximity of fenestration, the proposed single storey extension would result in significant overlooking and loss of privacy to the neighbouring dwellings, in particular, 80 Denton Avenue, Grantham. This would be detrimental to the reasonable residential amenities of occupiers of that property, contrary to the NPPF Section 12, and Policy DE1 of the South Kesteven Local Plan.

    During the debate, a Member asked if it would be possible to include a condition requiring a screen to be added to the first floor balcony on the proposed extension to the west. The planning officer confirmed that a condition could be added to this effect (condition 5 below). 

     

    The Interim Head of Development Management suggested that the wording of the ongoing condition could be expanded to prevent the approved outbuildings from being used for any other domestic purposes in the future. Members requested that additional wording to this effect be added to the condition and asked for the condition to be enforced by a Section 106 Agreement, to prevent the future conversion of the development for residential accommodation. 

     

    It was proposed, seconded and agreed that the Committee was minded to approve the application, with authority to be delegated to the Interim Head of Development Management, in consultation with the Chairman and Vice-Chairman of the Planning Committee, to approve the application subject to completion of a Section 106 Agreement to secure the requirements specified in the ongoing condition (condition 6 below).

     

    In the event that the agreement has not been concluded within a period of twelve-weeks from the date of the Committee, and where, in the opinion of the Interim Head of Development Management, there are not extenuating circumstances that would justify a further extension of time, the related planning application shall be refused planning permission for the appropriate reason(s) on the basis that the necessary requirements essential to make what would otherwise be unacceptable development acceptable have not been forthcoming.

     

    In the event that the Section 106 Agreement is concluded in the agreed timeframe and the Interim Head of Development Management approves the application, the development is to be subject to the following conditions:
