EXCLUSION OF THE PUBLIC EXCLUSION OF THE PUBLIC
In accordance with Section 100A(4) of the Local Government Act 1972, it was resolved that the public be excluded because of the likelihood in view of the nature of business to be transacted that if members of the public were present there would be disclosure to them of exempt information as defined in paragraphs 1 and 2 of Schedule 12A of the Act.

APPLICATION FOR A DUAL HACKNEY CARRIAGE/PRIVATE HIRE DRIVER'S LICENCE
Report ENV517 from the Community Safety and Licensing Service Manager. (Enclosure) Minutes: Decision:
That the application for a Dual Hackney Carriage/Private Hire Licence be approved as applied for, as the Committee are satisfied that the driver is a ‘fit and proper person’ pursuant to Sections 51 and 59 of the Local Government (Miscellaneous Provisions) Act 1976.
Note to the applicant: -
The Committee wished to place on record a strong warning to the applicant about his future driving conduct and his duty to keep the car in a good condition.
The Solicitor, Mr Rushworth introduced the Committee and Officers to the applicant and confirmed that the applicant was to speak on his own behalf.
The Licensing Officer, Mrs Robinson presented exempt report ENV517 which provided information about an application for a dual hackney carriage/private hire driver’s licence and associated background information. The Committee were being asked to decide whether the applicant was a fit and proper person to hold such a licence under Section 51 (a) and Section 59 (1) (a) of the Local Government (Miscellaneous Provisions) Act 1976.
The applicant than presented his case and answered Members questions.
The Licensing Officer than briefly made a closing statement and the Licensing Officers and applicant left the meeting. (10.07am)
Members considered the report, the applicant’s convictions; the time elapsed since the convictions and the applicant’s current behavior and agreed to approve the licence as they felt that the applicant was a ‘fit and proper person’ to hold a Dual Hackney Carriage/Private Hire Driver’s Licence. Concern was expressed about the car condition and it was suggested that a warning be given to the applicant about his future conduct and the condition of the car.
The Licensing Officers and applicant returned to the meeting at 10.14am and the Assistant Solicitor informed the applicant of the Committee’s decision to approve the licence as applied for and their warning about his future conduct and his duty to keep the car in a good condition.
