EXCLUSION OF THE PUBLIC In accordance with Section 100A(4) of the Local Government Act 1972, it was resolved that the public be excluded because of the likelihood in view of the nature of business to be transacted that if members of the public were present there would be disclosure to them of exempt information as defined in paragraphs 1 and 2 of Schedule 12A of the Act.

APPLICATION TO RENEW A HACKNEY CARRIAGE DRIVER'S LICENCE

Minutes: Decision
To refuse the application for a hackney carriage driver’s licence as due to the applicant’s behavior, it was determined that the applicant was not a fit and proper person to hold such a licence under Section 61(1)(a) of the Local Government (Miscellaneous Provisions) Act 1976.
The Principal Solicitor introduced those present to the applicant.
The Licensing Officer then presented exempt report ENV551 which concerned an application to renew a hackney carriage driver’s licence. He summarised the background information in chronological order and the alleged offences together with the facts given at interview with the Licensing Officers.
The applicant then presented his case and answered Members questions.
The Licensing Officer then gave a closing statement and reminded the Committee that they were being asked to decide whether the applicant was a fit and proper person to hold such a licence under Section 61(1)(a) of the Local Government (Miscellaneous Provisions) Act 1976 considering the information that they had received and the representations made at the meeting.
The Licensing Officers and applicant then left the meeting 11.15am.
Members discussed in detail the information they had received and the facts before them. They expressed great concern over the applicants behaviour and it was proposed, seconded and unanimously agreed that the applicant was not a fit and proper person to hold a hackney carriage driver’s licence under Section 61(1)(a) of the Local Government (Miscellaneous Provisions) Act 1976.
The Licensing Officers and applicant returned to the meeting 11.30am.
The Principal Solicitor informed the applicant that after careful deliberation of all the facts presented to the Committee the Committee’s decision is to refuse to renew his hackney carriage driver’s licence on the ground that he is not a fit and proper person to hold a hackney carriage driver’s licence under Section 61(1) (a) of the Local Government (Miscellaneous Provision) Act 1976. The applicant was advised that the decision was appealable to the Magistrates’ Court within twenty-one days from the date of the written decision
