Exclusion of the Public

It was anticipated that, in accordance with Section 100A (4) of the Local Government Act 1972 (as amended) the public may be excluded from the meeting during consideration of the following item of business because of the likelihood that otherwise exempt information, as described in paragraphs 1 and 2 of the Act (as amended) would be disclosed to the public.



Application to renew a Hackney Carriage Drivers Licence

    To refuse to renew the licence to drive a hackney carriage vehicle on the grounds that the applicant is not a fit and proper person to hold such a licence under section 61 (1) of the Local Government (Miscellaneous Provisions) Act 1976.


    The Legal Advisor introduced those present and confirmed that the applicant and his representative were in attendance.


    The Licensing Officer presented exempt report ENV725 which concerned an application to renew a hackney carriage driver’s licence.  The Licensing Officer detailed the background to the application before Members in chronological order and the steps that had been taken in relation to the applicant referring to the relevant appendices.  In February 2018 a hearing had been arranged at which the applicant together with a friend had attended with Officers from the Licensing Section, the Executive Manager Environment, a representative from Legal Services and the Vice-Chairman of the Licensing Committee to decide whether his licence should be subject to immediate revocation on the basis that he was not a fit and proper person in accordance with Section 61 (2b) of the Local Government (Miscellaneous Provisions) Act 1976. On the information available to them at that time it was decided that his licence would not be revoked.   In May 2019 the applicant had applied to renew his hackney carriage driver’s licence which was due to expire on 3 June 2019 and a temporary badge was issued to 4 August 2019.  In July 2019 the applicant provided a letter from the Head of DBS (Bedfordshire, Cambridgeshire and Hertfordshire), Cambridge Constabulary HQ. The letter informed the applicant that the Police held information relating to five separate complaints of assault against him between 2002 and 2018. The applicant had the opportunity to object to the information being disclosed as relevant DBS information on the certificate.  The DBS certificate was received by the Licensing section on 8 August 2019.  The Licensing Officer referred to the relevant detailed appendix in Members packs.  The Licensing Officer had requested clarification in relation to the wording and information on the DBS and had been told that the Barring Service would inform the person that they were barred for a period of time and it would be for that person to request to be removed from the list.  The applicant had not informed the authority that he had been placed on the list. As the applicants licence had effectively expired on 3 June he did not hold hackney carriage driver’s licence with this authority and cannot drive a hackney carriage vehicle licenced by this authority and a further temporary licence had not been issued due to the information contained on the DBS.


    The applicant’s representative then presented his client’s case.   He spoke about what the contents on the DBS meant in relation to his client and driving a hackney carriage.
