    That no hearing is required in relation to the application for Finkin’s, 20a High Street, Grantham.


    The Licensing Officer presented report ENV726, which related to an application for a premise licence in respect of Finkin’s, 20a High Street, Grantham for the supply of alcohol, Monday to Saturday 10:00 – 23:30 and Sunday 11:00 to 21:30.  Under the Live Music Act 2012, the provision of live music and the provision of recorded music are automatically granted between the hours of 08:00 and 23:00.


    On submission of the application the applicant was asked if she had contacted any of the responsible authorities, the applicant indicated that she had not.  Copes of the application form were sent to all Responsible Authorities. 


    On 23 December an e-mail was received from Lincolnshire Police objecting to the application as although the conditions submitted were extensive, the Police did not feel that they were adequate or that they fully promoted the Licensing Objectives.


    Where relevant representations are made, the Licensing Authority must hold a hearing to consider them unless the applicant and any person who has made a representation agree that a hearing was unnecessary.


    The applicant and the Police agreed to replace some and add further conditions to the application.  Correspondence was received from both parties which confirmed that a hearing was not necessary and could be dispensed with if the Licensing Authority agreed.


    Members considered the representation made and the subsequent amendments made to the application that had been agreed by both the applicant and the Police and all relevant guidance issued under section 182 of the Licensing Act 2003 and South Kesteven District Council’s Licensing Policy.  It was proposed, seconded and unanimously agreed that, as agreement had been reached between the applicant and Lincolnshire Police on the conditions to be attached to the Premise Licence a hearing could be dispensed with.
