Report ENV848 from the Licensing Officer for the determination of an application for a new premises licence. Additional documents: Minutes: Decision
That the application for the premises licence for Sutherland Way News, 32A Sutherland Way, Stamford PE9 2TB be granted subject to the conditions consistent with the operating schedule accompanying the application and any relevant mandatory conditions and also subject to an amendment to the hours agreed for the supply of alcohol off the premises of 06:00 – 22:00 Monday to Sunday.
The Legal Advisor introduced those present and confirmed who was speaking in respect of the application before the Committee. Luke Hilford, Licensing Solicitor on behalf of SAI Convenience UK Ltd and Mr Jagadeesh Kandasami, Premise Licence applicant and sole director of SAI Convenience UK Ltd.
The Licensing Officer presented the report which concerned a new premises licence for the premises known as Sutherland Way News, 32a Sutherland Way, Stamford, PE92TB. The application was for the supply of alcohol off the premises between the hours of 06:00 to 23:00, Monday to Sunday. Statutory consultations were undertaken and no representations were received from any of the responsible authorities. Nine representations were received from members of the public and these related to parking issues, operating hours and the proximity of another off licence. The representations received had the potential to fall under the prevention of public nuisance and the prevention of crime and disorder.
On 19 April 2023 an email was received form Knights Training in response to the representations received. Licensing Officers had the delegated authority to decide whether a representation was relevant, vexatious, or frivolous however, Section 9 of the Revised Guidance issued under section 182 of the Licensing Act 203 stated:
9.9 It is recommended that, in borderline cases, the benefit of the doubt about any aspect of a representation should be given to the person making that representation. The Subsequent hearing would then provide an opportunity for the person or body making the representation to amplify and clarify it.
The applicant’s solicitor then made their representation. The premises location had been a Post Office for a number of years and the applicant had bought the premises a few months ago. The premises continued to run as a Post Office together with a convenience store. To offer a more all-round service the application had been made for the sale of alcohol off the premises.
Mr Kandasami, was the sole director of SAI Convenience UK Ltd which had six premises and this included two petrol stations. Mr Kandasami had been involved with SAI for 10 years and held a personal licence. The locations of the other premises were located in and around Lincolnshire. There were good training procedures in place at all the locations and refresher training was carried out regularly together with making sure the CCTV worked and all areas immediately outside the premises were kept clean and tidy. Logs were completed accurately and self-checking procedures were in place and test purchases were carried out to ensure that asking for ID was a matter of good practice. Report ENV850 from the Licensing Officer for the determination of a variation to a Premise Licence. Additional documents: Minutes: The Chairman informed the Committee that the item had been removed from the agenda following its publication, as Planning had indicated no objection to the premise licence itself, due to the variation in hours requiring planning permission prior to implementation. In light of this, no other representations stand and the variation would be granted under officer delegated powers. |
