Minutes:

The minutes of the meeting held on 27th April 2012 were agreed as a correct record of the decisions taken subject to the following amendments: page 5 the premise to be replaced with local premises and page 6 penultimate paragraph last sentence to be deleted.   The amendments had been requested from one of the interested parties who had attended the meeting.

Decision:

 

That the application for a premise licence for the Bourne Public House at the junction of South Road and Raymond Mays Way Bourne be approved as applied for with the addition of a condition that all windows and doors will be kept shut during live and recorded music, save for access and egress and the application for Late Night Refreshment be granted for indoors only.

 

The Licensing Officer presented report CSL011 which concerned an application received on behalf of Marston’s PLC for a premises licence for premises that will be known as Bourne Public House, the premise had yet to be built.  The applicant had requested a permit for all activities as listed within the report and until midnight on Sunday and Monday on bank holiday weekends, Christmas Eve, Boxing Day, New Years Day and All Saints Day and New Years Eve 10.00am to 01.00 on the 2nd January. The application was also to serve alcohol to residents and their bona fide guests, the Licensing Officer had asked for clarification on this point as there was no accommodation on site.   Due to how the tills were configured if the manager required a drink once the premise was closed he would be classed as a resident.  A premise licence had already been applied for and granted but as the location of the building had changed slightly a new licence had been applied for and if approved the old licence would be surrendered.  An objection had been received from the Environmental Protection Team.  They wanted a condition added to the licence stating that “all doors and windows to be kept shut at all times during live and recorded music save for access or egress”.  The applicants were happy for the condition to be attached.

 

Members of the panel asked for clarification on points raised especially in connection with the configuration of the till. The Licensing Officer suggested that if members wished for more information the meeting could be adjourned.  Members decided to continue with the hearing.  A question was raised about the times shown in sections L and D pages 12 and 16 of the application as there seemed to be a contradiction on the application. The Licensing Officer clarified the correct time.   It was proposed, seconded and unanimously agreed to grant the licence as applied for subject to the addition of the condition that all doors and windows to be kept shut at all times during live and recorded music save for access or egress and the application for late night refreshment be granted for indoors only.

 

Members had raised concern about the new arrangements concerning the configuration of the till the Licensing Officer indicated that he would once again contact the applicants and report back to the next Committee on his findings.
