    That a hearing can be dispensed with in relation to the application for a new premise licence for the premises known as The Leaf, 15 Westgate, Grantham.

     

    The Licensing Officer presented report ENV720 which related to an application for a premises licence for the premises known as The Leaf, 15 Westgate, Grantham to include the sale of retail alcohol between the hours of 08:00 and 23:00 hours, Monday to Sunday inclusive.

     

    On 4 June a representation had been received from Lincolnshire Police under the licensing objectives of The Prevention of Crime and Disorder, Public Safety, Prevention of Public Nuisance and the Protection of Children from Harm.  Lincolnshire Police felt that the initial conditions offered on the operating procedures did not fully promote the licensing objectives.  Although consultation had taken place between the Police and the applicant before the application was submitted, a mistake by the applicant meant that the wrong conditions had been attached to the submitted application. 

     

    Where relevant representations are made, the Licensing Authority must hold a hearing to consider them, unless the Licensing Authority, the applicant and each person who had made a representation agree that a hearing is unnecessary.  For the purposes of the Licensing Act 2003, the Authority is the Alcohol, Entertainment and Late Night Refreshment Licensing Committee.

     

    The applicant was informed that he could cancel the application and submit a new application with the agreed conditions or, the existing application with the amendment to the conditions, agreed between himself and the Police could go to Committee for them to decide whether a hearing could be dispensed with.  The applicant agreed for the application with the amended conditions to go to Committee.

     

    The options available to the Committee were to consider the representations made to the application by Lincolnshire Police and the subsequent amendments made to the application in agreement with the Police and the applicant. The Committee needed to determine whether they agreed that a hearing could be dispensed with bearing in mind the four licensing objectives and giving appropriate weight to the promotion of the licensing objectives, the amendments presented by both parties, the guidance issued under Section 182 of the Licensing Act 2003 and South Kesteven District Council’s Licensing Policy.

    Members discussed the application before them having regard to all the information before them, the promotion of the licensing objectives and the guidance issued under Section 182 of the Licensing Act 2003 and South Kesteven District Council’s Licensing Policy. As agreement had been reached between the Police and the applicant on the conditions of the Premise Licence, Members unanimously agreed that a hearing could be dispensed with.

    That a hearing could be dispensed with in relation to the application for a new Premises Licence for the premises known as the Savoy Cinema, St Catherines Road, Grantham.

     

    The Licensing Officer presented report ENV721 which concerned an application for a new Premise Licence for the premises known as the Savoy Cinema, St Catherines Road, Grantham.   The application was for:

     

    Provision of plays;

    Provision of films;

    Provision of live and recorded music;

    Performance of dance;

    Any similar description to live and recorded music or performance of dance;

    Supply of alcohol.

     

    The Licensing Officer asked if the applicant had been in contact with the Police in relation to the application.  The applicant stated that the conditions were the same as those for the Savoy Cinema in Boston which had not be objected by the Police the previous year.  The application was accepted by the Licensing Officer.

     

    Where relevant representations are made, the Licensing Authority must hold a hearing to consider them, unless the Licensing Authority, the applicant and each person who had made a representation agree that a hearing is unnecessary.  For the purposes of the Licensing Act 2003, the Authority is the Alcohol, Entertainment and Late Night Refreshment Licensing Committee.

     

    A representation was received on 19 June 2019 from Lincolnshire Police, a responsible authority under the Licensing Act 2003, stating that the conditions were inadequate and did not fully promote the licensing objectives. 

     

    The Police consulted with the applicant about the conditions and an agreement was reached between both parties in connection with the conditions contained within the premise licence.

     

    Members queried the change in the conditions and the Licensing Officer stated the conditions were in relation to CCTV.

     

    The Licensing Officer then read out the options available to the Committee which were to consider the representations made to the application by Lincolnshire Police and the subsequent amendments made to the application in agreement with the Police and the applicant. The Committee needed to determine whether they agreed that a hearing could be dispensed with giving appropriate weight to the promotion of the licensing objectives, the amendments presented by both parties, the guidance issued under Section 182 of the Licensing Act 2003 and South Kesteven District Council’s Licensing Policy.
