It was proposed, seconded and agreed that the application be approved for the summary of reasons set out in the case officer’s report and subject also to the following conditions:

 1         The development hereby permitted shall be carried out in accordance with the following list of approved plans:

During Building Works

 

 2         The development must be carried out in accordance with the recommendations in the report prepared by Subadra Consulting Ltd received 27 February 2019, approved by S19/0411.

 

 3         Within 3 months of this permission, a verification report confirming that remedial works have been completed shall have been submitted to and approved in writing by the Local Planning Authority. The report shall have been submitted by the nominated competent person approved, as required by condition 2 above. The report shall include:

           

i.      A complete record of remediation activities, and data collected as identified in the remediation scheme, to support compliance with agreed remediation objectives;

ii.    As built drawings of the implemented scheme;

iii.   Photographs of the remediation works in progress; and

iv.   Certificates demonstrating that imported and/or material left in situ is free from contamination.

           

            The scheme of remediation shall thereafter be maintained in accordance with the approved scheme.

 

 4         Within 3 months of this permission, the acoustic fencing must be erected in accordance with the recommended details in Appendix D of the Nova Acoustics Ltd Noise Impact Assessment received 19/08/2019.

 

 5         Prior to any further development taking place within the undeveloped part of the site for a fuel and lubricant storage and distribution facility, a scheme for protecting the existing neighbouring residents from noise shall have been submitted to and approved in writing by the Local Planning Authority.

 

Before the Development is Occupied

 

 6         Before any part of the undeveloped part of the site is brought into use, all works which form part of the scheme to protect neighbouring residential development from noise shall have been completed in accordance with the approved details.

 

Ongoing Conditions

 

 7         With the exception of staff arrival and departure, and activities inside the buildings hereby permitted, no operations including loading/offloading of tankers, deliveries/dispatches and starting of lorries shall be undertaken outside the hours of 0700 and 1900 Monday to Saturday and at no time on Sundays and Bank Holidays.

 

 8         Prior to being brought into first use, the surface tanks shall have been fitted with carbon filters or other alternative odour filters and shall be retained as such thereafter and maintained in accordance with best practice guidelines.

 

 9         The site shall be operated in accordance with the noise mitigating measures identified within the Noise Impact Assessment prepared by Nova Acoustics Ltd received 19/08/2018.

 

14:23 – As Councillors Bellamy and Morgan had not been present when applications S18/2384, S18/2385, S18/2386 and S18/2387 were first discussed on 11 September 2019, and were not, therefore eligible to take part in determining the applications, they left the meeting and did not return.
