LICENSING ACT 2003 - APPLICATION FOR CONVERSION AND VARIANCE TO A LICENCE - THE ODD HOUSE, 4 FLETCHER STREET, GRANTHAM

Decision:-

 

That the application for conversion and variation to a licence in respect of The Odd House, 4 Fletcher Street, Grantham be agreed for the following hours for the sale of alcohol and subject to the conditions listed below:-

 

                          Monday to Thursday – 10.00am to 12midnight

                          Fridays and Saturdays – 10.00am to 1.00am

                          Sundays – 12noon to 12midnight

 

plus thirty minutes drinking up time

 

with an additional hour at holiday periods on a Sunday;

 

and subject to the following additional conditions:-

 

1.      live music to finish at 11.00pm;

2.      off sales not to commence before 10.00am;

3.      recorded music and live music to end at the same time as the sale of alcohol;

4.      after 10.30pm, all doors and windows to remain closed;

5.      that the applicant be requested to display suitable signs asking customers to have due consideration to local residents

           

Note – a meeting will take place between the applicants and local residents if there are any concerns.

 

The Committee had before them the Head of Environmental Health and Licensing’s report ENV285 in relation to an application for conversion and variation to a licence at The Odd House, 4 Fletcher Street, Grantham.  A full copy of the application was attached at appendix one together with a map of the premises.  Attached at appendix two were objections from the Lincolnshire Police (which had been later withdrawn) and from a local resident, Councillor Yvonne Gibbins.  The applicant and his representative were present at the meeting as was Councillor Gibbins. 

 

The Environmental Health Manager (Environment) then presented his report and outlined the hours of operation and variations to the licence proposed in respect of both live and recorded music. 

 

The applicant presented his case, and advised the Committee that he had reached an agreement with the police who now had no objection to the proposals.  The applicant confirmed that there was no intention to open for off sales at 8.00am.  The applicant also stated that he was not aware of any other noise nuisances at the public house other than those reported in the small hours of 7th August.  The Odd House was not a town centre public house and did not attract passing trade.  He was happy to keep all windows and doors closed after 10.30pm.

 

Councillor Yvonne Gibbins, as a local resident, submitted representations regarding noise and disturbance outside the premises which she stated had been occurring up to 2.30am.

 

In summing up his report, the Environmental Health Manager (Environment) recommended that the Committee consider the application.

 

The applicant summed up and, in asking the Committee to approve his application, pointed out that there were no objections from the police to their proposals and that the Environmental Health department had not been contacted in relation to noise nuisance.

                  

The applicant and officers then left the room.  The Committee then considered the application and it was proposed and seconded that the application be agreed with the variations as outlined above.  On being put to the vote, this was agreed.  The applicant and officers then returned to the meeting and were advised of the decision, as noted above.
