    Decision:                         To authorise the Assistant Director - Planning to REFUSE planning permission for the reasons set out in the report.

     

    During questions to officers and debate, Members commented on:

     

    ·            That the applicant had failed to provide necessary detailed evidence despite the provision of an extension to the deadline for this and had failed to secure affordable housing as part of the S106 agreement.

    ·            Members expressed agreement with the Case Officer’s recommendation for refusal.

    It was proposed, seconded and AGREED that the application be refused for the reasons set out in the Case Officer’s report:

    1.     The application proposals would involve the change of use of the former Westgate Social Club to Residential uses. The Applicant has failed to provide detailed documentary evidence that the site could not be retained for an alternative community and / or business facility, and the proposals would entail the provision of ground floor residential uses within the Grantham Town Centre boundary. As such, the application would be contrary to Policy SP6 and Policy GR4 of the adopted South Kesteven Local Plan 2011-2036 and Section 92 of the National Planning Policy Framework.

    2.     The Applicant has failed to agree to a planning obligation to secure the necessary affordable housing contributions, contrary to Policy H2 of the adopted South Kesteven Local Plan H2.

    Pre-commencement

     

    3.          Before the development hereby permitted is commenced, a scheme for the treatment of surface and foul water drainage shall have been submitted to and approved in writing by the Local Planning Authority.

     

    Reason: To ensure the provision of satisfactory surface and foul water drainage is provided in accordance with Policy EN5 of the adopted South Kesteven Local Plan.

     

    During Construction

     

    4.          Should the developer during excavation and construction works of the said development site find any area of the site where it is suspected that the land is contaminated then all works must stop and the local planning authority notified immediately. An investigation and risk assessment must be undertaken and where remediation is necessary a remediation scheme must be prepared in accordance with current good practice and legislation and submitted to and approved by the Local Planning Authority, and the approved remediation shall thereafter be implemented. Following completion of measures identified in the approved remediation scheme a verification report must be prepared, which is subject to the approval in writing of the Local Planning Authority.

     

    Reason: To comply with Policy EN4 of the Local Plan (2020).

     

    5.          The recommendations as set out in Section of the submitted Ecology Report ref RSE_5204_R1_01_LECIA dated January 2022 shall be complied with.
