Disclosure of interests
Members are asked to disclose any interests in matters for consideration at the meeting Minutes: No interests were disclosed.
One Member sought clarification on why a role call had not been completed and whether the minutes from the previous meeting would be taken to the next Planning Committee on 1 December 2022.
The Chairman confirmed that a role call was no longer necessary, due to attendance being recorded in the minutes of the meeting.
It was further verified that the agenda had been altered due to the attendance of public speakers.
It was proposed, seconded, and AGREED to alter the order of the agenda items.
It was proposed, seconded, and AGREED to suspend section 5.3 of the Planning Procedure Rules to ensure that Public Speakers have five minutes, rather than three due to an exceptional ‘one-off’ issue for both applications.

During questions to public speakers speaking against the application, Members commented on:
· Whether the proposed development would have a detrimental impact on local wildlife. The report confirmed that there was no evidence to support the argument that the increased number of days shooting would have a detrimental impact on wildlife beyond the impacts associated with the current authorised use and associated permitted development rights. · One Member queried the relevance of the go-karting activity in relation to the application. It was confirmed that noise from the adjacent go-karting was proposed to justify shooting activity to take place at a higher noise level. Concern was raised over the cumulative noise impact. · The location of the go-karting tracks was requested and provided to the Committee. · Clarification was sought around the differences between skeet and clay shooting. · Whether there had been evidence from the Parish Council that residents were using their leisure time to leave their properties to escape the noise of the activity. It was confirmed that over the years, residents had complained about the noise and the impacts this had on their leisure time. · A query was raised in relation to permitted development rights in the north and CIEH guidance in relation to clay shooting. · Clarification was sought on the terms of a ‘public shoot’ and whether people had been arriving at the shoot since 2017 without booking a slot. · Whether the land pollution from the shots could be quantified. It was advised that there had been no objections from neighbouring landowners regarding pollution, however, the land within the site could be polluted with lead and other debris from the historic use of the site for clay shooting. · Clarification over whether the proposal conflicted with SKDC planning policies. · Concerns over the Parish Council having a lack of trust in the applicant due to breaches of existing permissions. · Whether the extensive conditions outlined in the report met the needs of local residents.
One Member highlighted the objections from Fenton Parish Meeting that outlined lack of enforcement action from alleged breaches of the extant planning permission.

During questions to Officers and debate, Members commented on:
· Whether the approval of this application would prejudice the previous application decision. It was confirmed that the constructed clubhouse was justified in relation to the extant permission, therefore could be determined without prejudicing the previous application. · One Member queried what the inside of the clubhouse consisted of. The Principal Planning Officer highlighted that the clubhouse provides an amenity function for users of the shooting ground. The applicant would require an alcohol license under a separate legislation if they were to open a bar. · Whether the clubhouse structure would have to be removed, if the Committee decided to refuse the application. The Assistant Director of Planning confirmed that the clubhouse structure would not necessarily be removed if the application was refused, the Council would consider any enforcement action and the applicants would have the right to appeal the decision. · Clarification was sought over the difference between Gorse Lodge and Shoot Lodge. It was confirmed that they were both under the same ownership, but Gorse Lodge was now used as tourist accommodation. · Whether the clubhouse site had adequate toilet facilities. The Assistant Director of Planning confirmed a W/C was shown on the floor plans of the clubhouse.
It was proposed, seconded and AGREED to authorise the Assistant Director to GRANT planning permission subject to the following conditions:
