LICENSING ACT 2003 - APPLICATIONS FOR CONVERSION AND VARIATION TO A LICENCE - GRANTHAM BOWLING LIMITED, DYSART ROAD, GRANTHAM AND THE FIGHTING COCKS INN,13 MARKET PLACE, CORBY GLEN

Minutes:

Decision:-

 

1.                  That hearings into the application for transfer and variation to licences in respect of Grantham Bowling Limited in Grantham and The Fighting Cocks Inn, Corby Glen, are unnecessary;

and

2.                  That the Head of Environmental Health and Licensing be authorised to take the appropriate action in respect of the licence, in accordance with the schedule of licensing objectives submitted with the application.

 

The Head of Environmental Health and Licensing informed the Committee that the Police objections for Grantham Bowling Limited, Grantham and the Fighting Cocks Inn, Corby Glen had been withdrawn following consultation. As such he requested that the committee approve that a hearing would be unnecessary; this was proposed, seconded and approved.

That the application for conversion and variation to a licence in respect of The Corn Exchange Theatre Company, Broad Street, Stamford, as submitted, be agreed subject to the following hours for public entertainment:

 

Plays; Indoor Sporting Events; Boxing or Wrestling Entertainment; Provision of Facilities for Making Music; Provision of Facilities for Dancing; Provision for Like Entertainment; Films;

The Committee had before them the Head of Environmental Health and Licensing’s report ENV253 in relation to an application for conversion and variation to a licence for the Corn Exchange Theatre Company, Broad Street, Stamford. A full copy of the application was attached at appendix 1 together with a map of the premises and a letter of representation from a local resident at appendix 2.

 

The applicant was present at the meeting; the Chairman outlined the procedure that would be followed and introduced the Committee Members and officers present. The applicant stated that he had been advised of the procedure that would be followed, which he understood.

 

The Head of Environmental Health and Licensing presented his report, drawing the attention of the Committee to the sale of alcohol as a new licensable activity; this had previously been covered on an ad hoc basis by temporary Magistrate’s licences. An extension of the times of entertainment was also requested. He stated that one letter of objection had been received from a local resident.

 

The applicant presented his case, stating that development of the premises would create a bar/restaurant. The building also houses special events, at which alcohol would be available. The variation of the licence would grant the capacity for a greater range of events to operate over an increased number of hours.

 

Members then asked a variety of questions in relation to: public availability of the bar/restaurant, anti-social behaviour in the area of the Corn Exchange, the amplification of music, the type of events that would be staged within the building and other businesses in the vicinity of the Corn Exchange licensed to sell alcohol.

 

The Head of Environmental Health and Licensing, in summing up, recommended that the committee consider the application for both increased hours for public entertainment and the sale of alcohol and reminded them about the letter of representation received. The applicant then summed up and the officers and applicant left the room.

 

The Committee discussed the application in terms of the benefit of the facility to the public, fulfilling a specialised need, the potential for an increase in anti-social behaviour and admission and readmission to the premises.

That the application for conversion and variation to a licence in respect of The Periwig, All Saints Street, Stamford, be agreed as submitted with the exclusion of variations 3 and 5 for the sale of alcohol:

and subject to thirty minutes drinking up time.

 

The Committee had before them, the Head of Environmental Health and Licensing’s report ENV255 in relation to an application for the conversion and variation to a licence for the Periwig, Stamford. A full copy of the application was attached as appendix 1, together with a map of the premises. Representations had been received from the Environment Team and a local resident; these were attached as appendix 2.

 

Present at the meeting were the applicant and his legal representative. The Chairman outlined the procedure to be followed and introduced the Committee members and officers present at the meeting. The applicants confirmed that they were aware of the procedure that would be followed at the meeting.

 

The Head of Environmental Health and Licensing presented his report, drawing the attention of the Committee to the Justices Licence and the special hours certificate held by the premises. Representations had been received from the Environment Team and a local resident; both objected on the ground of noise pollution. The variation would permit the playing of films for longer hours than previously permitted. The applicant had stated that items 3 and 5 of the proposed variation had been withdrawn. On removing these elements, the Environment Team withdrew their objection.

 

Members clarified whether the resident who objected was local to The Periwig.

 

The representative of the applicant confirmed items 3 and 5 of the proposed variation had been withdrawn. Removal of these would negate the representation from the local resident. The applicant had included modified undertakings from the Special Hours Certificate in the application including the provision of door staff from 20:30 onwards and no admissions or readmissions after 23:00. The applicant confirmed he was a member of the Pubwatch scheme.

 

The Head of Environmental Health and Licensing concluded, asking the committee to determine the request for variation. The applicant added nothing further. The Corporate Manager of Democratic and Legal Services clarified that variations 3 and 5 had been deleted in entirety and that the Committee should only consider items 1, 2 and 4; the applicant confirmed this. The applicant, representative and officers left the room.

 

The committee discussed the application. It was proposed and seconded that the application for transfer and variation be approved, excluding variations 3 and 5, as agreed. On being put to the vote, this was approved.

 

The applicant, representative and officers re-entered the meeting and were advised of the decision, as noted above. The Corporate Manager of Democratic and Legal Services confirmed that the licence would be subject to review by interested parties at any time.

That the application for conversion and variation to a licence in respect of the Blue Pig, Vine Street, Grantham be granted for the following times for the sale of alcohol:-

 

            11:00 to 00:30                       Monday to Thursday

            11:00 to 01:30                       Friday

            10:30 to 01:30                       Saturday

            12:00 to 23:30                       Sunday

 

And subject to thirty minutes drinking up time and also to the following conditions:

 

1.                  That the beer garden must close at 22:30 every day;

 

2.                  That there will be no external music played in the beer garden;

 

3.                  That there will be no admission or readmission after 23:30, to be policed by the landlord;

 

4.                  That CCTV tapes will be kept for 28 days;

 

5.                  That a notice will be displayed near the exit requesting patrons leave quietly.

The Committee had before them report ENV257 by the Head of Environmental Health and Licensing, regarding an application for conversion and variation for the Blue Pig, Grantham. A full copy of the application and a plan of the site were attached as appendix 1. Representations had been received from the Lincolnshire Police and six local residents; copies of these had been attached as appendix 2.

 

Present at the meeting were the applicant, the applicants legal representative, the police and three members of the public who had stated that they wished to make representations. The Chairman outlined the procedure that would be followed and introduced the committee members and officers present. The applicants confirmed that they were aware of the procedure that would be followed.

 

The Head of Environmental Health and Licensing presented his report, drawing the attention of the committee to the variation of opening hours and the addition of ten minutes drinking up time; it would also include live music and indoor sporting events as licensable activities. He drew attention in particular to representations that had been received from the Lincolnshire Police attached in appendix 2. Dialogue between the police and the applicant had led to the withdrawal of the police objection. He also referred to various letters of objection from local residents.

 

The applicant confirmed that after discussions with the police, the request for varying operating times on 30 unspecified occasions had been withdrawn as being unlawful. The applicant confirmed that CCTV tapes would be kept for the period specified by the police. Both parties had agreed that an admission and readmission policy would be unviable. The applicant stated that the beer garden would be closed at 23:00 and its use would be seasonal.

 

The representative from the police confirmed the agreement had been made stipulating admission or readmission would best be policed by the applicant.

 

Members asked the police representative about any recent incidents directly attributable to the premises and confirmed that after discussion, they had withdrawn their objection.

That the application in respect of The Vine, Market Deeping be agreed as submitted for the following hours for the sale of alcohol:-

 

            11:00 to 23:00             Weekdays and Saturdays

            12:00 to 22:30                       Sundays

 

and subject to thirty minutes drinking up time, with extended hours on bank holidays including one additional hour on Mondays at bank holiday. The licence also includes the retention of the Two in a Bar Rule.

 

The Committee had before them report number ENV258 by the Head of Environmental Health and Licensing regarding the conversion and variation to a licence for The Vine, Market Deeping. The completed application and a plan of the premises were attached as appendix 1 and a representation received from a local resident attached as appendix 2.

 

Present at the meeting were a representative of the applicant and the manager of the premises. The Chairman outlined the procedure that would be followed during the meeting and then introduced the committee members and officers present. The applicants confirmed that they understood the procedure that would be followed in determining the application.

 

In introducing his report, the Head of Environmental Health and Licensing outlined the variations that had been requested and drew the attention of the committee to a representation that had been received from a local resident.

 

The applicant’s representative requested that the Committee also consider the increased hours on Mondays at bank holidays as part of the variation; these hours would be from 10:30 to 00:00. This had previously been covered under grandfather rights. The representative of the applicant requested that the licence include the retention of the Two in a Bar Rule. The applicant stated that no complaints about The Vine had been received by any of the interested authorities.

 

In summing up, the Head of Environmental Health and Licensing stated that the application was straightforward, converting previously held items not covered under new legislation. The representative of the applicant summed up.

 

The applicants and the officers then left the room.

 

The Committee discussed the application and it was proposed and seconded that the conversion and variation be approved as submitted (including Mondays at bank holidays). On being put to the vote, this was agreed.

 

The applicants and officers returned to the meeting and were advised of the decision, as noted above. The Corporate Manager of Democratic and Legal Services reminded the applicant’s representative that the licence would be subject to constant review by any interested parties.
