  1. That the hearing into the application for transfer and variation to a licence in respect of The Deeping Stage Hotel, 16 Market Place, Market Deeping is unnecessary;

 

and

 

  1. That the Head of Environmental Health and Licensing be authorised to take the appropriate action in respect of the licence, in accordance with the schedule of licensing objectives submitted with the application.

 

The Environmental Health Manager informed the committee that he had received verbal confirmation that an agreement had been reached between the applicant and Lincolnshire Police concerning their representation regarding hours for the sale of alcohol and open vessels leaving the premises. The applicant and police representative were present to confirm this to the committee. The Environmental Health Manager therefore requested that the committee agree that a hearing would be unnecessary and that the Head of Environmental Health and Licensing be permitted to take appropriate action in respect of the licence. This was subsequently proposed and seconded and was carried on being put to the vote.

LICENSING ACT 2003 - APPLICATION FOR CONVERSION AND VARIATION TO A LICENCE - NOBODY INN, 9 NORTH STREET, GRANTHAM

Decision: -

 

That the application for conversion and variation to a licence in respect of Nobody Inn, 9 North Street, Grantham, be granted as submitted for the following hours for the sale of alcohol:-

 

11.00hrs to 00.00hrs Monday to Sunday

 

subject to thirty minutes drinking up time and subject to the removal of non-standard timings.

 

The committee had before them report ENV292 by the Head of Environmental Health and Licensing in relation to an application for conversion and variation to a licence for Nobody Inn, 9 North Street, Grantham. A full copy of the application was attached as appendix one, including a map showing the premises, and an objection from Lincolnshire Police at appendix two.

 

The Environmental Health Manager, in introducing the application, clarified the representative present from Lincolnshire Police, and that the applicant was not present. He then presented the report of the Head of Environmental Health and Licensing outlining the hours of operation proposed and the objection received.

 

The police representative confirmed the objection of Lincolnshire Police relating to the applicant’s request for non-standard timings. The representative was asked to confirm whether or not Lincolnshire Police objected to the proposed hours of operation for Sunday and he replied that they did not.

 

The officers and police representatives then left the meeting. During the ensuing discussion, members expressed views in relation to the hours of operation applying to Sundays. The officers and police representatives were invited back into the meeting to clarify. The police representative confirmed that they did not object to the hours of operation and the Environmental Health Manager explained the provisions of the Council’s Licensing Policy and Government guidance.

 

The officers and police representative then left the meeting. As there was no basis for refusing the hours of operation, it was proposed and seconded that the application as submitted be approved but without non-standard timings. On being put to the vote, this was agreed.

 

The officers and police representative then returned to the meeting and were advised of the decision, as noted above.

LICENSING ACT 2003 - APPLICATION FOR CONVERSION AND VARIATION TO A LICENCE - THE GREEK AFFAIR, 9 ST. MARY'S STREET, STAMFORD

  1. That the hearing into the application for transfer and variation to a licence in respect of The Greek Affair, 9 St. Mary’s Street, Stamford is unnecessary;

 

and

 

  1. That the Head of Environmental Health and Licensing be authorised to take the appropriate action in respect of the licence, in accordance with the schedule of licensing objectives submitted with the respective application. 

 

The Environmental Health Manager informed the committee that there had been two representations received in relation to the application from The Greek Affair, 9 St. Mary’s Street, Stamford.  The representation concerning opening hours had been a misunderstanding on the part of the objector and had therefore been withdrawn. The representation from Lincolnshire Police, concerning non-standard timings, had been acknowledged by the applicant and the relevant section of the application withdrawn. The police representative circulated a letter from the applicant’s agent which confirmed this. It was then proposed and seconded that a hearing was unnecessary and this was carried on being put to the vote.

LICENSING ACT 2003 - APPLICATION FOR CONVERSION AND VARIATION TO A LICENCE - THE ROSE CASTLE, TRENT ROAD, GRANTHAM

Decision: -

 

That the application for conversion and variation to a licence in respect of The Rose Castle, Trent Road, Grantham be agreed for the following hours for the sale of alcohol:-

 

            11.00hrs to 00.00hrs – Monday to Saturday

            11.00hrs to 22.30hrs – Sunday

 

and subject to thirty minutes drinking up time, and subject also to the following conditions:-

 

  1. CCTV be installed and operated during opening hours and tapes retained for no less than twenty-eight days.

 

  1. Outside areas cease to be used by 22.30hrs for all purposes.

 

  1. Non-standard timings be removed.

 

 

The committee had before them the Head of Environmental Health and Licensing’s report ENV294 in relation to an application for conversion and variance to a licence for The Rose and Castle, Trent Road, Grantham. A full copy of the application was attached at appendix one together with a plan showing the location of the premises. Comments from Lincolnshire Police were attached at appendix two. 

 

The Environmental Health Manager introduced the application and the police representative present. The applicant was not present at the meeting. The committee clarified with the officer the location of the outside area to which the application made reference. The police representative then confirmed the organisation’s objection to opening outside licensed hours to show televised sporting events, non-standard timings and other areas of concern relating to crime and disorder and public nuisance. Lincolnshire Police also requested that should the licence be granted, CCTV installation be made a condition of the licence.

 

The officers and police representative then left the meeting. The committee then considered the application and noted the objections and comments of Lincolnshire Police. Given the crime and disorder and public nuisance concerns identified by Lincolnshire Police, it was considered that hours for the sale of alcohol should be limited until 00.00hrs Monday to Saturday and until 22.30hrs on Sunday. It was proposed and seconded that the application be agreed subject to these varied hours and the conditions requested by Lincolnshire Police. On being put to the vote, this was agreed.

 

The officers and police representative then returned to the meeting and were advised of the decision, as noted above.

LICENSING ACT 2003 - APPLICATION FOR CONVERSION AND VARIATION TO A LICENCE - THE BULL INN, 3 HIGH STREET, RIPPINGALE, BOURNE

Decision: -

 

That the hearing into the application for transfer and variation to a licence in respect of The Bull Inn, 3 High Street, Rippingale, Bourne, be deferred until clarification is received on the applicant’s response to representations from Lincolnshire County Council Trading Standards.

 

The Environmental Health Manager informed the committee that it was understood that the representations from Lincolnshire County Council Trading Standards in relation to The Bull Inn, 3 High Street, Rippingale, Bourne had been agreed by the applicant. There was, however, no confirmation of this.

 

Trading Standards had been concerned that the applicant had applied to allow children onto the premises but did not appear to hold a Children’s Certificate. It was also considered that the applicant had not adequately addressed the issues relating to the sale of alcohol to persons under the age of eighteen.

 

Given the seriousness of the representations, it was proposed and seconded that the hearing be deferred until the applicant’s response to the representations could be determined. The was agreed on being put to the vote.
