2.                  That the Head of Environmental Health and Licensing be authorised to take the appropriate action in respect of the licence, in accordance with the schedule of licensing objectives submitted with the application.

 

The Head of Environmental Health and Licensing informed the committee that the police objection for The George Hotel, High Street, Stamford had been withdrawn following consultation. As such he requested that the committee agree that a hearing would be unnecessary and that he be permitted to take appropriate action in respect of the licence.

The Committee had before them the Head of Environmental Health and Licensing’s report ENV305 in relation to an application for conversion and variation to a licence for The George and Dragon, Victoria Street, Billingborough. A full copy of the application was attached as appendix 1 together with a map of the premises. 3 representations had been received from interested parties were attached as appendix 2.

 

A representative of the applicant was present at the meeting. The Chairman outlined the procedure that would be followed and introduced the Committee Members and Officers present. The applicant’s representative stated that he had been advised of the procedure that would be followed, which he understood.

 

The Head of Environmental Health and Licensing presented his report, drawing the attention of the Committee to the variations applied for, including use for indoor sporting events, live music (two in a bar), recorded music and dancing. He stated that 3 letters of representation had been received from interested parties. A member of the Committee clarified the residence of the complainants.

 

The applicant presented his case, emphasising that no representations had been received from the police, the fire service or the environmental health department. The application would allow dispersal over a longer period. The applicant’s representative stated that they would close all windows and doors, place signs asking patrons to respect local residents and meet with local residents to address any concerns.

 

Members of the Committee asked a variety of questions and clarified on and off sales.

 

The Head of Environmental Health and Licensing, in summing up, recommended that the committee consider the application for transfer and variation and reminded them of the representations received. The applicant then summed up and the officers and applicant left the room.

LICENSING ACT 2003 - APPLICATION FOR A LICENCE - ZORBAS, 40 BROAD STREET STAMFORD

That the application in respect of Zorbas, 40 Broad Street, Stamford be agreed subject to the following hours for the provision of late night refreshment:

 

23:00 to 00:30                       Sunday to Tuesday

23:00 to 02:30                       Wednesday to Saturday

 

And subject to the following conditions:

 

1.                  That the public area immediately surrounding the premises shall be cleared of waste food, food containers, wrapping, etc. at the end of trading on each day. Such refuse shall be placed in a container designed for the storage and disposal of refuse and waste foods which shall be constructed, maintained and located so that access to it by vermin and unauthorised persons is prevented and arrangements shall be made for the regular lawful disposal of their contents.

 

2.                  That the existing CCTV installation shall be maintained and all resulting tapes shall be kept for a period of no less than 28 days and made available to the police if required.

 

The Committee had before them the Head of Environmental Health and Licensing’s report ENV307 in relation to an application for a Premises for Zorbas, 40 Broad Street, Stamford. A full copy of the application was attached as appendix 1 together with a map of the premises. Representations received from 44 interested parties were attached as appendix 2. A letter of representation from Lincolnshire Police was circulated at the meeting.

 

The applicants and their representative were present at the meeting; the Chairman outlined the procedure that would be followed and introduced the Committee Members and Officers present. The applicants stated that they had been advised of the procedure that would be followed, which they understood. Three members of the public had given notice that they wished to speak and a representative of Lincolnshire Police was also present.

 

The Head of Environmental Health and Licensing presented his report, reminding the Committee that the application was for a Premises Licence to cover the supply of late night refreshment, (only licensable between 23:00 to 05:00). He stated that 44 letters of representation had been received from interested parties. Representations had also been received from Lincolnshire Police.

 

The applicants presented their case, emphasising that the premises did not sell alcohol. The opening hours were integrated with the night time economy. The property was fitted with CCTV cameras. They stated that they were recognised under the legislation as being responsible for their premises and its frontage only. The applicants were questioned about supervision for customers, litter caused by patrons and local responsibility.

 

The Police representative stated that increased opening hours would promote loitering in town centres and anti-social behaviour. Within the past year, two incidents had been reported at Zorbas. The applicant questioned the Police representative on incidents directly attributable to Zorbas. The Police representative answered questions on this and public nuisance.

 

Three members of the public made representations against the application. The Committee had before them the Head of Environmental Health and Licensing’s report ENV310 in relation to an application for conversion and variation to a licence for The Daniel Lambert, 20 St. Leonard’s Street, Stamford. A full copy of the application was attached as appendix 1 together with a map of the premises. Representations received from Lincolnshire Police and local residents were attached as appendix 2.

 

Present at the meeting were representatives of the applicants, and the police, and the Chairman then outlined the procedure to be followed and introduced the committee members and officers present at the meeting. The applicants confirmed that they were aware of the procedure to be followed in determining the application.

 

The Head of Environmental Health and Licensing, in outlining his report, confirmed that following discussions between the applicants and the police, agreement had now been reached and the hours requested would be reduced.

 

The applicant confirmed that discussions had taken place with the police in relation to the hours for the sale of alcohol and a no admissions/readmissions policy after 23:00. The police confirmed their agreement. The officers, police and applicant left the room.

 

It was then proposed and seconded that the application be agreed subject to the hours for the sale of alcohol being varied to a closure time of twelve midnight on Monday to Thursday; 01:00 on Friday and Saturday and 23:30 on Sunday, subject to thirty minutes drinking up time with the inclusion of a condition allowing no admission or readmission after 23:00. The Committee requested a sign be displayed asking patrons to leave quietly. On being put to the vote the proposition was agreed.

 

The applicant and officers returned and were advised of the decision, as noted above, by the Committee Support Officer

A representative of the applicant was present at the meeting; the Chairman outlined the procedure that would be followed and introduced the Committee Members and Officers present. The applicant stated that he had been advised of the procedure that would be followed, which he understood. A representative of the Lincolnshire Police and two members of the public who had given notice that they wished to speak were also present at the meeting.

 

The Head of Environmental Health and Licensing presented his report, drawing the attention of the Committee to the proposed variation of times for the sale of alcohol and additional drinking up time. He stated that thirteen letters of representation had been received from interested parties. The premises currently had provision for “Two in a Bar” and that the only bank holiday variation that had been applied for was New Year. The applicant had undertaken negotiations with the police.

 

The applicant stated that the request for live music and dancing had been withdrawn from the application. The application still covered the playing of recorded music, showing films and the sale of alcohol. The schedule of operation included provision for staff training, membership of Pubwatch, a Sensible Drinking Policy, zero tolerance for drug users, a no admission/readmission policy after 23:00 and any incidents would be recorded in an incident book, which would be made available for the police or the Licensing Authority to inspect. When questioned, the applicant stated that the premises had no CCTV. The applicant also answered questions about proposed opening times.

 

Two members of the public raised issues including noise nuisance when the premises were under previous management. They confirmed that there had been no problems since new management had taken over. The applicant was present at the meeting; the Chairman outlined the procedure that would be followed and introduced the Committee Members and Officers present. The applicant stated that he had been advised of the procedure, which he understood.

 

The Head of Environmental Health and Licensing presented his report; the application was for an extension to the hours of licensable activity and an additional 40 minutes drinking up time. He stated that letters of representation had been received from interested parties.

 

The applicant stated that he had a more mature customer base, who had requested that he apply for additional time, to avoid having to go to the town centre. The applicant was a member of the LVA and Pubwatch. On being questioned, the applicant confirmed that the application included use of the beer garden for all times requested. He stated that any external recorded music would be kept to a low level.

 

The Head of Environmental Health and Licensing, in summing up, recommended that the committee consider the application for conversion and variation and reminded them of the representations received. The applicant then summed up and the officers and applicant left the room.

 

The Committee discussed the application, which was duly proposed and seconded as presented. On being put to the vote, this was approved.

 

The applicant and officers then returned to the meeting and were advised of the decision, as noted above.
