LICENSING ACT 2003 - APPLICATION FOR CONVERSION AND VARIATION TO A LICENCE - FRATELLIS RESTAURANT, 13 ST. MARY'S HILL, STAMFORD
Minutes: Decision: -
That the Committee determines that a hearing is not necessary in respect of this application and the Head of Environmental Health and Licensing be authorised to determine the application as appropriate in accordance with the schedule of licensing objections submitted with the respective application.
The Environmental Health Manager (Environment) advised the Committee that agreement had been reached between the applicants and the police in respect of opening times and a hearing was therefore no longer necessary. The motion was duly moved and seconded. |

LICENSING ACT 2003 - APPLICATION FOR CONVERSION AND VARIATION TO A LICENCE - WOODY'S BAR, WOODLAND WATERS LIMITED, ANCASTER
Minutes: Decision: -
That the application for conversion and variation to a licence in respect of Woody’s Bar, Woodland Waters Limited, Ancaster be agreed as submitted subject to the additional conditions relating to the provision of new toilets by 1st January 2006, the retention of existing noise control conditions in respect of the premises and amendments to the noise control conditions relating to the new function room.
The Committee had before them the Head of Environmental Health and Licensing’s report ENV314 in relation to an application for conversion and variation to a licence for Woody’s Bar, Woodland Waters Limited, Ancaster. A full copy of the application was attached as appendix one including a map showing the premises and letters of objection were attached as appendix two. The Environmental Health Manager (Environment) then presented his report and outlined the hours of operation proposed. Much of the objections related to the temporary marquee building but the Environmental Health Practitioner (Commercial) advised that agreement had now been reached with the applicant in respect of a new building with toilet provision for which planning permission had already been obtained and building works commenced. The objection was therefore withdrawn as long as the new toilets were in operation by 1st January 2006. The applicant presented his case and advised of the position with regard to the new toilet provision. He explained that the function hall would be for occasional functions and there would be no late night refreshments on a Sunday.
Summing up his report, the Environmental Health Manager (Environment) recommended that the Committee consider the application.
The applicant summed up and in asking the Committee to approve his application, confirmed that he would be prepared to retain the existing noise restrictions relating to the premises.
The applicant and officers then left the room. The Committee considered the application and it was proposed and seconded that the application be agreed with additional conditions as outlined above. On being put to the vote this was agreed.
The applicant and officers then returned to the meeting and were advised of the decision as noted above. |

LICENSING ACT 2003 - APPLICATION FOR CONVERSION AND VARIATION TO A LICENCE - ROCK FILLING STATION, SCOTGATE, STAMFORD

That the application for conversion and variation to a licence in respect of The Rock Filling Station, Scotgate, Stamford be agreed for the following hours for the sale of alcohol and activities requested: -
Late night refreshments – 23.00hrs to 05.00hrs – Monday to Sunday Supply of alcohol – 08.00hrs to 23.00hrs – Monday to Sunday Premises opening times – 00.01hrs to 00.00hrs Monday to Sunday.
The Committee had before them the Head of Environmental Health and Licensing’s report ENV16 in relation to an application for conversion and variation to a licence for The Rock Filling Station, Scotgate, Stamford. A full copy of the application was attached as appendix one together with a map of the premises. Attached at appendix two were objections from local residents.
The applicants were represented by Mr Geoffrey Buck of BP Oil and Ms Susannah Fitzgerald, a Barrister.
The Environmental Health Manager (Environment) then presented his report and outlined the hours of operation proposed together with additional activities.
The applicant’s representatives presented their case pointing out that no objections had been received from the police to the proposals. The applicant’s representatives emphasised that alcohol would only be on sale from 08.00hrs to 23.00hrs and local residents may have formed the impression that the application was for twenty-four hour licensing. The premises already had a licence until 23.00hrs except for Sundays, Christmas Day and Good Friday and the application was intended to bring all the hours in line. The late night refreshments would cover hot drinks and some hot food which would be served through a hatch. The shop would not be open for twenty-four hours. There would also be CCTV and appropriate alarms.
In summing up his report, the Environmental Health Manager (Environment) recommended that the Committee consider the application.
The applicant’s representatives then summed up their case and asked the Committee to approve the application. The applicants and officers then left the room. The Committee considered the application and it was proposed and seconded that the application be granted. On being put to the vote, this was agreed.
The applicants and officers then returned to the meeting and were advised of the decision as noted above. |

That the application for conversion and variation to a licence in respect of Ciro, 34 North Street, Bourne be agreed for the following hours for the sale of alcohol and activities requested: -
Late night refreshments – 23.00hrs to 01.30hrs – Monday to Saturday 23.00hrs to 00.00hrs – Sunday
Supply of alcohol – 10.00hrs to 01.30hrs – Monday to Saturday 10.00 to 00.00hrs – Sunday
Plus thirty minutes drinking up time.
Opening hours - 10.00hrs to 02.00hrs – Monday to Saturday 10.00hrs to 00.30hrs – Sunday
Subject also to an additional condition stating that high-quality CCTV will be provided to the satisfaction of Lincolnshire Constabulary and that the tapes be retained in unaltered form for thirty-one days.
The Committee had before them the Head of Environmental Health and Licensing’s report ENV318 in relation to an application for conversion and variation to a licence at Ciro, 34 North Street, Bourne. A full copy of the application was attached at appendix one together with a map of the premises. Attached at appendix two were objections from local residents.
Neither the applicants, the objectors nor the police were present at the meeting.
The Environmental Health Manager (Environment) then presented his report and outlined the hours of operation together with additional activities.
A further letter had been received from the applicants’ solicitors in respect of the objections received and this was circulated at the meeting.
In summing up his report, the Environmental Health Manager (Environment) recommended that the Committee consider the application. The officers then left the room.
The Committee considered the application and it was proposed and seconded that the application be agreed as amended above. On being put to the vote this was agreed.
The officers then returned to the meeting and were advised of the decision as noted above. |
