That the Committee determines that a hearing is not necessary in respect of this application and the Head of Environmental Health and Licensing be authorised to determine the application as appropriate in accordance with the schedule of licensing objections submitted with the respective application.

 

The Environmental Health Manager (Environment) advised the Committee that agreement had been reached between the applicants and the police in respect of closing times on Sundays and Bank Holiday Mondays and a hearing was therefore no longer necessary.  The motion was duly moved and seconded.

That the committee determine that a hearing is not necessary in respect of this application and the Head of Environmental Health and Licensing be authorised to determine the application as appropriate in accordance with the schedule of licensing objections submitted with the respective application.

 

The Environmental Health Manager (Environment) advised the Committee that agreement had been reached between the applicants and the police in respect of opening hours and a hearing was therefore no longer necessary.  PC K Stanley of Lincolnshire Police confirmed that this was the case and it was therefore moved and seconded that this application be delegated to the Head of Environmental Health Services and Licensing to determine.

That on the receipt of legal advice and on considering the representations from the police, this application be adjourned since an incident of a serious nature had taken place over the previous weekend which may have an impact on the premises licence. 

 

The Committee had before them the Head of Environmental Health and Licensing’s report ENV280 in relation to an application for conversion and variation to a licence for The Royal Oak, 27 Market Place, Grantham.

 

The applicant and the police both attended the hearing and the police officer present (Inspector Rose) reported that since the last hearing there had been an incident of a serious nature which may impinge upon the licensing objectives.  He therefore requested that the application should be adjourned.  Upon receipt of police and legal advice, it was therefore moved and seconded that the above application be adjourned.

LICENSING ACT 2003 - APPLICATION FOR CONVERSION AND VARIANCE TO A LICENCE - DRUM AND MONKEY, 67 CASTERTON ROAD, STAMFORD

That the application for conversion and variation to a licence in respect of The Drum and Monkey, Casterton Road, Stamford be agreed as submitted except that only thirty minutes drinking up time be allowed, not sixty minutes, and that permission will not be granted to allow the public house to remain open until midnight on twenty other occasions at the applicant’s discretion with seven days prior notice to the police.

           

The Committee had before them the Head of Environmental Health and Licensing’s report ENV284 in relation to an application for conversion and variation to a licence for The Drum and Monkey, 67 Casterton Road, Stamford.  A full copy of the application was attached as appendix one, including a map showing the premises, and a letter from the Lincolnshire Police objecting to certain of the applicant’s proposals was attached as appendix two.  The Environmental Health Manager (Environment) then presented his report and outlined the hours of operation proposed.  The applicant had asked for a variation to permit regulated entertainment, to permit the premises to open for licensable activities, to show the broadcast of televised sporting events of national or international interest outside normal operating hours, to allow the sale of alcohol and to remove all embedded restrictions.  He had also requested an additional forty minutes drinking up time, to allow sixty minutes drinking up time after the last permitted sale of alcohol and a variation to permit regulated entertainment, to permit the premises to open until midnight on twenty other occasions at the applicant’s discretion with seven days prior notice to the police.

 

The applicant was not present to present his case, but PC Stanley of Lincolnshire Police explained the reasons for the police objections in respect of the twenty additional late openings and opening outside of normal licensed hours to show broadcasts of televised sporting events which, in their view, was a clear attempt to circumnavigate the need for a Temporary Event Notice (TEN).

 

In summing up his report, the Environmental Health Manager (Environment) recommended that the committee consider the applicant’s written request as well as the objections from the police.  The police and the officers then left the room, the committee considered the application and it was proposed and seconded that the application be agreed except that the sixty minutes drinking up time be reduced to thirty minutes and that the twenty extra occasions at which the premises could remain open until midnight was not agreed.  The police and officers then returned to the meeting and were advised of the decision, as noted above.

That the application for conversion and variation to a licence in respect of The Odd House, 4 Fletcher Street, Grantham be agreed for the following hours for the sale of alcohol and subject to the conditions listed below:-

 

                          Monday to Thursday – 10.00am to 12midnight

                          Fridays and Saturdays – 10.00am to 1.00am

                          Sundays – 12noon to 12midnight

 

plus thirty minutes drinking up time

 

with an additional hour at holiday periods on a Sunday;

 

and subject to the following additional conditions:-

 

1.      live music to finish at 11.00pm;

2.      off sales not to commence before 10.00am;

3.      recorded music and live music to end at the same time as the sale of alcohol;

4.      after 10.30pm, all doors and windows to remain closed;

5.      that the applicant be requested to display suitable signs asking customers to have due consideration to local residents

           

Note – a meeting will take place between the applicants and local residents if there are any concerns.

 

The Committee had before them the Head of Environmental Health and Licensing’s report ENV285 in relation to an application for conversion and variation to a licence at The Odd House, 4 Fletcher Street, Grantham.  A full copy of the application was attached at appendix one together with a map of the premises.  Attached at appendix two were objections from the Lincolnshire Police (which had been later withdrawn) and from a local resident, Councillor Yvonne Gibbins.  The applicant and his representative were present at the meeting as was Councillor Gibbins. 

 

The Environmental Health Manager (Environment) then presented his report and outlined the hours of operation and variations to the licence proposed in respect of both live and recorded music. 

 

The applicant presented his case, and advised the Committee that he had reached an agreement with the police who now had no objection to the proposals.  The applicant confirmed that there was no intention to open for off sales at 8.00am.  The applicant also stated that he was not aware of any other noise nuisances at the public house other than those reported in the small hours of 7th August.  The Odd House was not a town centre public house and did not attract passing trade.  He was happy to keep all windows and doors closed after 10.30pm.

 

Councillor Yvonne Gibbins, as a local resident, submitted representations regarding noise and disturbance outside the premises which she stated had been occurring up to 2.30am.

 

In summing up his report, the Environmental Health Manager (Environment) recommended that the Committee consider the application.

 

The applicant summed up and, in asking the Committee to approve his application, pointed out that there were no objections from the police to their proposals and that the Environmental Health department had not been contacted in relation to noise nuisance.

Present at the meeting was the applicant who confirmed that he had received a copy of the procedure to be followed in considering the application, and that this was understood.  Also present was a representative of Lincolnshire Police.

 

The Environmental Health Manager (Environment) then presented his report and outlined the hours of operation proposed together with additional activities. 

 

The applicant presented his case, pointing out that no objection had been received from the police to his proposals.  In respect of live music, the bar was only large enough to accommodate a duo, although it would be possible to present a jazz trio in the patio area once every six months or so.  This was a food-led pub, not a music-led one.  He confirmed that he was considering staging karaoke evenings, possibly once every quarter.  The windows to the premises were secured and none of them could be opened.  The applicant confirmed that there was a beer garden to the rear of the premises together with a separate children’s play area.

That the application for conversion and variation to a licence in respect of The Establishment, 90 Westgate, Grantham be agreed for the following hours for the sale of alcohol and activities requested:-

 

11.00am to 2.00am – Monday to Saturday

11.00am to 12.30am – Sunday

 

and subject to the following additional conditions:-

 

1.      No admission or re-admission after 12 midnight;

2.      door staff to be on duty from 9.00pm when open beyond 12midnight;

3.      such staff to remain on duty until close of sales of alcohol;

4.      the number of door staff to be two for the first one hundred, then one per one hundred customers above that figure;

5.      CCTV records to be kept for twenty-eight days;

6.      no admission or re-admission after 12 midnight;

The Committee had before them the Head of Environmental Health and Licensing’s report ENV286 in relation to an application for conversion and variation to the licence for The Establishment, 90 Westgate, Grantham.  A full copy of the application was attached at appendix one together with a map of the premises.  A letter of representation from Lincolnshire Police was attached as appendix two. 

 

Present at the meeting was a representative of the applicant and Inspector Rose of Lincolnshire Police.  The Environmental Health Manager (Environment) then presented the report and outlined the hours of operation proposed together with the hours requested for live music, recorded music and dancing.  There was already a public entertainment licence in respect of the premises and the applicants were seeking a further additional hour into the morning for the activities covered by the public entertainment licence and the existing justices licence. 

 

The applicant then presented his case.  It was confirmed that any door staff would have to be registered by the Security Industries Authority and that the police and local authority had powers to check these for registration, badges etc. 

 

In summing up his report, the Environmental Health Manager (Environment) recommended that the Committee consider the application.

 

The applicant summed up his case. The applicants and officers then left the room. The Committee considered the application and it was proposed and seconded that the application be agreed as outlined above. On being put to the vote, this was agreed.
