    Members heard information from one of the Council’s Environmental Protection Officers who explained readings that the service had collected from air quality monitoring at points close to the A1 in Grantham. Discussion also ensued on the potential impact of the development on air quality and the volume of traffic on the A1, including periods where traffic was static or slow moving and the movement of heavy goods vehicles.

     

    It was proposed and seconded that the application be approved subject to conditions and the completion of a Section 106 Agreement. Notice was given of a further proposition, which was to defer the application to enable local air quality readings to be taken in the event that the proposition to approve failed.

    Members outlined their experiences of exiting from the car park associated with the application site and turning right onto Dysart Road. It was suggested that the concerns should be fed into the Grantham Road Strategy Group, which was looking at the transport strategy for the whole of the town centre and could lead to a Traffic Regulation Order being made with a view to relieving traffic issues in the area.

     

    It was proposed, seconded and agreed that the application be approved for the reasons set out in the case officer’s report and subject to the conditions set out on page 75 of the case officer’s report and subject to completion of a Section 106 agreement to secure the requirements specified in section 8.1 of the report. Where the Section 106 obligation has not been concluded prior to the Committee, a period not exceeding twelve weeks after the date of the Committee shall be set for the completion of that obligation.

     

    In the event that the agreement has not been concluded within the twelve-week period and where, in the opinion of the Head of Development Management, there are not extenuating circumstances that would justify a further extension of time, the related planning application shall be refused planning permission for the appropriate reason(s) on the basis that the necessary requirements essential to make what would otherwise be unacceptable development acceptable have not been forthcoming.

    It was proposed, seconded and agreed that the application be refused for the following reasons:

     

     

    1.             The development, if permitted, would fail to preserve the significance of both the Grade I Listed St Nicholas Church, Fulbeck; and the Grade II* Listed Fulbeck Hall.  The development would also fail to preserve or enhance the character and appearance of the Fulbeck Conservation Area.  As such the proposal would fail to accord with Policy EN1 of the South Kesteven Core Strategy (2010) and Section 16 of the NPPF (2019) as it causes less than substantial harm to the significance of St. Nicholas Church (Grade I), Fulbeck Hall (Grade II*) and Fulbeck Conservation Area, along with guidance at paragraph 22 of Planning Policy for Traveller Sites (August 2015).  The public benefits associated with the proposals in respect of the provision of gypsy and traveller accommodation does not outweigh the harm caused to heritage assets in this instance.

     

    2.             Insufficient information has been submitted to show that the site would be drained sufficiently and appropriately to ensure both an acceptable living environment for future residents, and to prevent the risk of flooding to neighbouring properties in accordance with the requirements of Policies H4 and EN2 of the South Kesteven Core Strategy (2010); paragraph 163 of the NPPF (2019) and the relevant provisions of Planning Policy for Traveller Sites (August 2015).  ...  view the full minutes text for item 29d

    1.    The road layout and difficult pedestrian and cycle access meant that the application did not promote healthy and safe communities or promote health, inclusivity and safe spaces. Reference was made to crossing issues and the accident history along the A15 between Bourne and Market Deeping

    2.    The application was contrary to guidance on sustainable transport and should give priority to pedestrian and cycle movements, creating spaces that were safe, secure and attractive that will minimise conflicts, avoid unnecessary street clutter and respond to local character and design standards. The development should also be designed to incorporate charging for plug-in and ultra-low emission vehicles

    3.    The development site was not allocated within the existing or emerging Local Plan documents

    Following the determination of the Committee that it was minded to refuse application S18/2263 and the relationship between the two applications, it was proposed and seconded that the application be refused. The Head of Development Management again invoked the cooling-off period. This meant that the Committee was minded to refuse the application and that final determination would be made in parallel to the decision on application S18/2264.

     

    In accordance with the Constitution, a recorded vote was taken:

     

    For: Councillors Adams, Benn, Bisnauthsing, Dilks, Milnes, Reid and Judy Smith (7 Members)

    Against: (No members)

    Abstain: Councillors Exton and Jacky Smith (2 Members)

     

    The vote was carried and those Committee members who voted in favour of refusal of the application had five working days to provide the Head of Development Management with the planning reasons for their view, together with supporting evidence. The application would be placed on the agenda for consideration at the next meeting of the Planning Committee when the Head of Development Management would provide her opinion on whether the reasons advanced were substantial enough for the authority to defend the decision at an inquiry. In light of any additional information, the committee would then be empowered to determine the application without being fettered by their vote at the previous meeting.

    It was proposed, seconded and agreed that the Council submits the following comments to Lincolnshire County Council as the waste planning authority:

     

    The Council notes the potential additional impacts of an increase in waste transfer levels and urges the County Council to give due consideration to highway implications including increased parking and possible adverse impacts on amenity on surrounding developments, particularly the children’s nursery, through odour noise, and other pollution that may result.

     

    The Council requests that Lincolnshire County Council takes all representations it has received directly from local residents in South Kesteven and the concerns raised by Market Deeping Parish Council into consideration in determining the application.
